Statutory Property Guardianship Regulation takes effect Dec. 1

On December 1, 2014, the Statutory Property Guardianship Regulation will be brought into force which impacts the process of assessing adults who are thought to not be capable of managing their financial affairs and are in need for the Public Guardian and Trustee (PGT) to their formal Committee of Estate. This change will affect all staff supporting adults with diminished capability.

Some of those staff within the organization have been or will be identified by their managers as ‘Qualified Health Care Providers’ (QHCP), and authorized to complete the new – more formal – assessments which will be submitted to the PGT and a ‘Health Authority Designate’ for consideration of a Certificate of Incapability. After December 1, if a formal Certificate of Incapability appears to be a potential outcome, staff who have not been authorized as QHCPs will need to engage a QHCP to complete the formal assessment on their patient or client.

A working group involving staff and leaders from VCH and PHC is working in partnership with the Ministry of Health and the Public Guardian and Trustee to prepare for the changes and to make accessible education, training, and practice guidance – and a straightforward system – for all staff and physicians involved in supporting adults with diminished capability.
